Help with EAD extension!! Staying on I94

Hello,

Our L1B, L2 visas got expired.We are currently staying on I94.My husbands I94(L1B) is valid till April 22nd 2015 and their company is going to file extension for him this march 2015 however my L2 I94 is valid till May 2016 so they are not filing any extension for me.Can I apply for L2 EAD(EAD expiring on April 1st 2015) extension in this case and what are the chances of my EAD getting approved.

Whenever you apply for ead you will get a validity of 2 years normally or till the i94 date of the L1b or the i94 date of l2 whichever is earlier.So if you apply now you might end up getting till April 2015 .If you submit your spouses extension documents along with your Ead application you will get it once his extension is approved..if you apply after your spouses extension is approved you might have to wait another 90 days for your ead approval loosing some more time. On the other hand if you apply while your husbands extension is on process there is a possibility that your ead will be rejected if his extension is rejected and you will end up wasting the money for the application.
Now you need to decide which would be best for you.
Looking at high rejection rates of L1 extension i would wait for the approval.
