Hi,
I am currently working with Company A on L1B visa since Jan 2013. Company A filed extension in Mar 2015 (under normal processing) as the visa and i94 are getting expired in Apr, 2015. As it may take around 3-4 months for normal processing so I am expecting the decision would come in June/July. Current extension rejection rate is very high so I am looking for H1B which company B is ready to file (but only as COS not as Counselor Processing).
I have below questions :
1. If H1B application is picked up in the lottery and L1 extension is approved and I go for vacation to India(before October) can I come back on L1 (after L1 stamping) ?
2. Will there be any issue in the consulate for stamping since I have already applied for H1 and the decision is pending?
3. Or if I go for vacation after Oct-1(after H1B approval) and want to stay with L1, will there be still any issue for L1 stamping?
