  • L1 cycle reset condition

    My L1 visa validity start date was Feb'10 and visa expiration date was Feb'13. I first entered US on 3-Mar-2010 and my latest exit date from US is 19-Oct-2014. Between this period my total stay in US was little over 3 years. My question is if I apply for Visa in April but travel only after 19th Oct'15 (1 year after my last departure date from US) will my L1 counter get reset and the subsequent l1 extensions or h1 application ignore the previous 3 years i spent till 19th Oct 2014.

    If you are outside US for a continuous span of 365 days or more, and apply with a different petition, your Maximum Physical Stay counter will be reset.

      Thanks Shaan for the reply. My question was if I apply for L1 now which is less than 365 days from my last exit from US but travel to US only after completing 365 days will any further L1 extension or H1 application ignore the duration i spent in USA pre 19th Oct'2014 and will consider latest L1 cycle for full 5 years and 6 years for H1.

      I am asking this question because if I get a visa and travel to US now then both my L1 and H1 will consider my current L1 cycle during extension/application respectively.
