  • L-1B Visa Eligibility Questions

    Hi all,

My employer, one of the big US tech giants, would like to transfer me to the US from Ireland under their L-1B blanket petition. What I understand is that for an L-1B intracompany transferee, I need to have one continuous year out of the last three working at the company in a specialized knowledge capacity. The company lawyers provided a large amount of evidence for my case (support letter, verifying academic credentials, etc.) I have worked at the company for 13 months, but have spent a cumulative month of it (never more than 2 weeks) in the US.

My lawyers have informed me that I should apply for the visa as soon as the 365 days are up, due to some timing constraints on the company's part. I have booked the consular interview on the 366th day (This is according to the days in my I-94 record, counting all the partial days so Jun 3 - Jun 5 = 3 days). I understand that this is cutting it very fine; under the L-1 regulations, there is no way for a denial due to the non-fulfillment of one continuous year requirement, correct (specialized knowledge requirements aside)? Also, what kind of evidence can I provide to prove I've met the requirement?
