  • L1-A Individual Processing held under 221g - New Delhi Consulate

    Hi Folks,

Last week I was interview at the Embassy new delhi for L1-A individual visa.

The VO asked 4-5 questions and then 1 to my wife. He said you are good to go and would be intimated via email for passport updates.

On the way back home we got a call from the embassy saying " can you come back". I told them it would take time as I am almost 20kms away, to which he said no problems and he will send an email asking some documentations.
Later that day i received the email saying processing has been suspended under 221g and asked for documents like Invitation letter, resume, research, sponsor etc. I replied the email same day.

    Now my Qs :

Has anyone else also gone through the same process i.e. call received from embassy and then email.
If the VO had to issue me a 221g why he said "good to go" at the end of the interview.
I have a L1-A Individual approved petition from USCIS, what are the chances that I would get the visa approved.
What are the average case resolution time in such 221g cases.
Anyone who applied in New Delhi and faced same issue ?

    Thanks

Generally research papers and resume are required if one of the applicant has studied in a TAL list occupation (such as Nuclear Physics, Microbiology, etc). So it does surprise me that they called you exclusively and asked to submit resume and research papers.

There is no time frame for a 221G resolution, you just have to patiently wait it out and provide documents as and when asked for.

This is my opinion not legal advice.

            Hi Raghvi,

Is it normal for the Embassy to retain the passports while the application is under 221g processing.

Is there a way out in which we can ask the embassy to give back the passport and continue processing.

            Thanks.

Yes it is normal. But if you want to request for your passport back, while the admin processing is going on, you can always do so.

                Hi Raghvi,

The status of my application now says "Issued". What this exactly means....

I spoke to the call centre of US travel docs & they say that this means your visa is in final processing. Its not sure that it means its approved or not. This can only be confirmed once you have a passport in hand.

Now I am really really confused

                  Hi Abhi,

What is the current status of your L1 stamping? Was your passport approved of L1 visa?

I am in a similar situation with my H1B stamping, except that I have not been asked for any documents. I have just been asked to wait and there is no control number on my 221G for me to track.

Any help in alleviating my fears would be helpful...

                  Regards,

                  Sowmya
