  • Applying for New L1. I had I140 Approved based on H1

    Hi,

    I was in US from 2007 to 2011 and my employer has filed I140 and it got approved. I appeared in H1B visa renewal and got 221G from canada and my employer withdraws I129.

    I moved back to india and started job. Now my current company wants to apply for my new L1.

    My questions are:

    1. What should I write in My questionnaire regarding (Has the alien ever made a previous application for an immigrant visa/permanent residence)? Yes or No? If Yes.. Explain

    2. Will it impact on getting my L1? what questions they can ask and what would be the best answer?

    1. Your answer should be Yes. An I140 is a Immigrant petition.
    2. I dont think this will impact your L1. Questions would typically be around the L1 position and your claim on it.
