Current L1b visa expires Jul 25 2015. H1b application this Apr by same employer

    Hi Everyone,

    I have an active L1b (blanket) ending July 25 2015 with my current employer. Same employer has also decided to file for my H1b this year with premium processing. There is no talk about L1 extension yet, I want to wait till the H1 application goes in. Before my L1 was approved, I also had a B1/B2. My spouse is on H1 visa.

    If the H1 application is not picked up in lottery (if there's one this year) or denied, the employer will have no option but to file for L1 extension (3-4 months under normal processing).

    1. My assumption is that, if this happens I will be able to continue staying in US (unless the L1 extension is denied). Can someone confirm that ?

    Can someone help fill in this blanks:
    2. If H1b petition is approved, do ____________ to fill the interim period between Jul 25 and Oct 1.
    Probable options are (i) change to B1 OR (ii) Change to H4 OR (iii) Apply for L1 extension OR (iv) Work from India OR (v) Other

      1. Assuming L1 I94 is also expiring 25-Jul-2015, then as long as L1 extension is applied before I-94 expiry you should be good to stay and work till max 240 days or Extension denied.
      2. A lot depends upon the documentation and comfort you have with respect to L1 extension and if it is in premium. tryign to move to B1 and then H1 would be my least preferred choice, if you dont fancy your chances of a L1 extension the option would be to go out of US before L1 I-94 expiry, work from India, await H1 approval notice, go for H1 stamping, and return on H1.
