  • Travel To India - L2 -EAD to H1B under process

    Hi All,

Currently, I am on valid L2 EAD till NOV 2016.
My employer has initiated H1B COS application and will be filing H1B during April 1st week. I am not sure about the lottery pick dates and approval dates. Appreciate if you can provide clarification on the below queries

    Questions:
    1. What is the expected H1 B lottery pick dates ?
    2. What will be the expected time to get the application approved ?
    3. Can i Travel to India in the month of mid May 2015 and come back to USA in mid June 2015 ? as I am still on valid L2

Any complications if I travel india during the mentioned dates while my H1 B application is under processing.

    Thank You.

    1. No one can predict, it would depend upon USCIS, but general trend is between Mid April to End April. If there is a lottery, there are two lottery, one with only Master's and one with remaining Masters and others.
    2. Depends, Masters? Premium?
    3. There are numerous threads advising against travel while a COS is pending.

This is my opinion not legal advice.
