  • L1B from 2015 into Green card

    Hi,

my company and I agree to relocate to US last year. this January 2015 I was granted with a L1B visa for 3 years.
I was wondering what are the chances to convert into a green card:
    - processing time? - how long would this process take?
    - when the process could start?
    - what are the steps of the process?
    - is there any option to speed it up with a fee?
    - what are the fees involved?
    - is there any pre requisite to apply for it?
    - do I need to be in possession of a good standing visa to be involved in the GC process?
    - what are the company considerations or requisites to apply?
    - I am understand that If i am granted with the GC, my family as well?

sorry, but I am new on the process, therefore any lights would be highly appreciated.

    thanks in advance.

    Best regards

First thing you need to determine from your Company is under which EB category would they be filing your Permanent Work Position in. EB1/EB2/EB3, which in turn will depend upon the role you would be playing for them . Then it depends upon your country of Birth to ascertain time for getting the GC.

This is my opinion not legal advice.

      thanks Raghvi,

I believe EB3 as skilled worked may make sense at this stage.
My country of origin would be Spain.

I hope it helps to provide further indications.

      Regards

EB3 is current for Oct-2014 for Spain. So those who applied in Oct-2014 can apply for their GC and AOS. So you are looking at a wait time of 6 Months.

-processing time? - how long would this process take? - PERM, if no audit, 6-8 Months. And as your Priority dates are very close by you probably can get it within 1 Year.
        - when the process could start? - Anytime the employer is willing to.
        - what are the steps of the process? - First PERM needs to be filed. Does your company have a lawyer handling this? Without that it would be difficult.
        - is there any option to speed it up with a fee? - I dont think you can expedite it as long as priority date is not current.
        - what are the fees involved? It depends upon the attorney and number of family members. general Cost would range from 3-10K USD.
        - is there any pre requisite to apply for it? Yes. Read http://www.uscis.gov/working-united-...reference-eb-3
        - do I need to be in possession of a good standing visa to be involved in the GC process? Not required.
        - what are the company considerations or requisites to apply? That is internal policy check with your HR.
        - I am understand that If i am granted with the GC, my family as well? When you say family does it include spouse/children or parents? As each will follow a different category.

This is my opinion not legal advice.
