    Hi there experts and experienced folks,
    Here is my case: I work for a US company as a "full time consultant" in a managerial capacity in India. Been with it for 2 years. Would I be eligible for applying for a L1 visa? Except for not being on the payroll and not having employee benefits, I think I satisfy all other employee-employer relationship requirements.

    Case 2: If I get on their payroll now, would I be then eligible to apply ? (given the 1 year rule) Is it applicable to L1A as well ?

    I am really looking at L1 and not H1B, Would appreciate your advice and help.

    If you are not on active payrol, the concerned entity, its affiliates or subsidiaries cannot sponsor your L1 visa.

    However, if you get employed by the company (direct payroll) for at least one year within the past 3 years of continuous employment, you might be eligible for L1 visa provided other requirements are also satisfied.
