    L1 Visa holder with traffic violations - reckless driving in NC - will it be a issue on Immigration process or Visa statmping?

    Hi All,

    I am on L1 visa. Recently when I was travelling with my family, I was cited for speeding violation for speeding more than 90mph (kind of speed trap, many cited along with me, anyway that is different discussion). My traffic attorney brought it down to reckless driving rather speeding still I am not sure how reckless driving is lesser offense than speeding 90mph).
    BTW, my question is, as per NC traffic law, reckless driving is Class 2 misdemeanor. I was not arrested or finger printed, it was just ticket and now in court my attorney is bringing it to reckless driving with fine. He told me that only implications is driving and license points. With respect to NC Class 2 misdemeanor act, will it impact my immigration? Will there be any issue later if I go for visa stamping or GC. Please let me know.

    As long as the consulate / USCIS does not consider your violation as a CMT, there should not be any problems. But do keep all paper work related to your case handy whenever you go for visa interview / GC application. Else your application might be put on hold and take much longer time to process.

    However, bear in mind that if you had your family with you in the car, and that included a minor child, you can be considered as a person with morality problem as you endangered not just your but your family members' lives as well. In that event, your violation might be classified under CMT.

    And lastly, considerstions under immigration laws are different from those under different state or federal laws. It is at the discretion of the consulate / USCIS to determine how they want to categorize your violation.
