Hi All,

I am on L1B visa and maxing out in May 2015. My Perm has been certified.
1) Do I have to be in US for I 140 to be applied and approved?
2) Assuming that I 140 can be applied and approved even if I am in India can I apply for non-cap H1 B immediately or do I have to wait for 1 year after Max out date?

Can somebody help me.

1. I dont think you need to be in US.
2. You can apply only if Cap is still open. As of today this year's Cap is filled already next will open April 2016, with a start date of Oct 2016.
