  • Clarifications regarding L1 visa

I am looking for some clarifications as regards L1 visa -
Can L1 visa be filed by small companies - the size of 5-10 employees. There is a requirement with regard to granting of L1 visa that that the employee in question should have worked with the filing company for at least one continuous year abroad (abroad like India) withing the previous 3 years. My question is - what type of proof the L1 visa filing company has to provide to USCIS to support that - indeed the employee has worked with them for 1 year like that ?? ....Some PAN card entries ?? .....Some Bank deposit entries ?? ....... Tax return statements??? Thank you.

I dont think there is a restriction in small company applying for L1. The challenge you might face is proving substantial business ties between the company's US entity and their non US entity. As for 1 Year requirement, Salary Slips and Tax return statements should be good.

This is my opinion not legal advice.
