  • Delay with EAD for L2

    Hey Guys

26th Jan : USCIS had recieved my application for EAD on the . Following a week, they sent me a notification via email and also in the mail that they have received my documents and the agreed fee for $380.00 and nothing is outstanding. Though, when I checked for the status of the case Online, it said that USCIS has sent me a Notice to confirm if there are any additional Details required.
26th Feb : I waited for exact a month and then called USCIS Customer Service team and filed a e Request or a Service Request so that they can sent me the Notice again if at all any documents are required
12th Mar : I received an email that there is no Bio metric required for me and that USCIS would let me know on the proceedings.
19th Mar : Called Customer service Team and they told that they can only Expedite after 75 days
13th Apr : Called the Customer Service Team and she filed a E Request to expedite the matter
21st Apr : Out of urgency and Curiosity, called the service team again. The person told me that its just 5 days to 90 days and so I should wait. if I do not get my EAD till the 90 day mark, I can call back and request for an Temporary EAD which should be valid for 240 days
24th Apr :To my utmost surprise causing me more frustration, when I check the status of the case Online, it says that they have NOW reviewed the case and they require certain documents for which they have sent me a mail.

Can someone please confirm any solution in here as my case if now over 90 days and any communication from USCIS seems inaccurate to me. What should I do now. My employer is waiting as well. Is there some issues with EAD TATs.

    Thanks!
    Thanks! Gilbert

27th Apr : Called the Service Desk and spoke to them for 24 mins. No help. As per her, would have to first wait for the Notice to be received in mail which should be responded on by a Deadline as mentioned on the Notice. Since the case shows suspended, hence no Interim EAD can be granted till then.

    Issues :
(1)why was the information requested for missing documents on the 88th day. Why couldn't they have reviewed the case way before the 90 days mark
(2)The Customer Desk that we speak with does not track or document the notes from the conversation as a result you have to explain them the whole scenario again
    (3) you get to speak to a new agent each time which helps build no rapo at all and sometimes mis guides you as they come up with mis leading facts
    (4) Even with the first Online case status, they mentioned that a Notice was sent to me via email which I never received, I has called this team and raised an SR even then but there was no help meaning no Notice was sent to me even then
    (5) Now they have told me that I can schedule for an Info Pass once that I have sent the documents over as Requested by the agreed timelines

I am going to wait till the 30th Apr noon and call the Service Desk incase nothing is received, Would keep you posted.

    Thanks!
    Thanks! Gilbert

Basis my readings of similar forums, One of them specified that they received the EAD without the Bio-metrics performed. This is seldom however possible.

        Hi,

1st May - I have received the Notice from USCIS and they have asked me to Submit the I-94 form of my spouse along with the Original Notice. To my surprise, the Process does not ask any any given point to submit these details initially. If so, this additional Document should be a part of the Process when one is filling originally and not requested later.

        Thanks!
        Thanks! Gilbert

              Hey Guys :

what an irony this is. I called up USCIS today and wanted to check with the team on how long this would take as I can confirm now that the Vermont office has already received the additional documents they requested for.
When I told her that USCIS requested for the i-94 for my spouse, which is not at all required by the Original process, the Person mis-guided me again stating that it is required and read out the para from page 3.

              E.
Spouse of an L-1 Intracompany Transferee--(a)(18).
File Form I-765 with evidence of your lawful status
and evidence you are a spouse of a principal L-1, such
as your Form I-94, and a copy of the principal's visa
and your marriage certificate. (Other relatives or
dependents of L-1 aliens who are in L status are not
eligible for employment authorization and may not file
              under this category.)

              Thanks!
              Thanks! Gilbert

                22nd May -
Spoke to the Associate in the USCIS Department and told them how my case has been delayed and how USCIS has asked for a document which was never part of the original Instructions. She confirmed that if USCIS feel that some other document is required, they ask for that later. Ha ha! Should they call that as a Missing document or additional information.
Anyways, she has now filed a SR and told me that USCIS would get back to me in 5 business days which should be the 2nd of June considering the Memorial Day.
Now the case is 4 months old. Also, took a verbal confirmation from them that a Bio Metric is not at all required for my case. Though I have that documented on an email from USCIS.

                Thanks! Gaurav
                Thanks! Gilbert

5th June - I received an email from USCIS confirming that this is in response to my Service Requuest. Since, I was requested for additional documents, hence the 90 days rule for EAD approval has been over ruled and that the Dept. shall re-look at my case. This start for a fresh 90 days tenure for case review.

I think what they are doing is setting up a realistic deadline to my case. As of then, when I look at the Case status Online, It confirms that I should have a confirmation by the July 6th

                    Thanks!

                    - - - Updated - - -

12th June - When I heck fr the status of Pending EAD case Online, the status has changed slightly wherein the Threshold date of July 6th has been removed from the status. It simply says we are looking in to your case and shall let you know. Puts me in a dicy situation here.

                    Thanks!

15th June- The status shows that the EAD Application has been approved and that USCIS has sent me the approval document through email. Waiting for the same. SHould be there in mail in 5-7 business days, so by next week mid by max.

                    Thanks! Gaurav
                    Thanks! Gilbert

Got L2 ead approval in 82 day

If you have a job offer, do not wait after 75 days. I contacted the Senate office on the 75th day and then followed up 3 more times after that which led to my EAD getting approved on the 82nd day.
