  • L1B Visa Extension

    Hi,

My husband is on L1 B Visa now. He is a remote employee (works from Home). His i94 expires in February 2016.
I have my L2 EAD till December 2015, I am currently working now.
    My question is
    1. Is there more chances of L1B extension rejection because he is a remote employee?
    2. Can i apply for my EAD extension till February 2016 (as i have till dec 2015, buy husbands i94 till febraury 2016)?

    Pls answer.

    1. Possible, why does he need to be in US when he can do the work from home, anywhere in the world?
    2. Any particular reason why you got I-94 only till Dec 2015? Is your passport expiring in that Month?

This is my opinion not legal advice.

      and have one more question
      1. would employer mention that my husband is a remote employee in L1 extension documentation?

If you got a newer passport, then yes you can request for an extension of I94 base don your spouse's I-94 till Feb 2016, but considering the fact that its a difference of only 2-3 Months (Dec 2015 till Feb 2016) I would suggest you apply L1 Extension in premium, along with L2 extension and EAD all together.

The employer has to specify a particular location for the intended employment.

This is my opinion not legal advice.
