  • Having L1B and dependent L1A visa

    Hi,
I have an L1B visa which is valid until Feb 2016.
Two months ago I also stamped my L1A dependent (of my husband) visa.

My husband and I are planning to travel to the US , I will work for my employer there.
I am assuming that since I have an L1B visa I can work for my employer till Feb 16.
My question is : since my dependent visa is the latest one , can I still work on my L1 for my employer.
Also while working on the L1 visa can I file for EAD , so that I can work on L1A dependent after my L1B expires ?

    Thank You.

Dependent visa of L1 is called as L2 visa. So if I understand correctly, you have L1B through your employer and L2 visa through your spouse, both stamped and valid in the passport. As and when you enter US you have to show to respective visa on which you are entering US. Make sure you point the correct one, otherwise it may lead to confusion and wrong status update.

So assuming you decide to use your L1 visa to enter US, then you should present your employer related documents (I797 primarily) and once in US you must work for the L1 employer.
While working on L1 visa, you cannot apply for L2 EAD, in order to get L2-EAD you would have to apply L1 to L2 COS (I539) + EAD(I765) .

The potential concern that you may have to handle is that, you have to apply for L1 to L2 COS + EAD before Feb 2016, and the approval of L2+EAD can take Months. You cannot work during this phase.

This is my opinion not legal advice.
