  • L1-Individual VISA expiration -- renewal or H4/EAD

    Hello,

    Quick summary of my situation:

    ā€” My L1-Individual VISA expires in March-2016
ā€” My wife is working in the US on an H1-B VISA and has her i140 approved.

Question-1: For L1 VISA extension. We need to decide whether to do a paper-extension of the L1 VISA, or to go out of the country and get it re-stamped.
My lawyer said that there are 2 options for VISA extension:
    1. Go outside the US, schedule an appointment with the US consulate and get the VISA re-stamped.
    2. No need to go outside the US. The lawyers will file a paper-extension-request.

The lawyer said that the risk of getting rejection/RFE's are higher in option#2. Is this correct? Can anyone comment based on their experience (or opinion). :-)
My budget would not allow me to travel to India. Would it be any better/worse to get the VISA extension done from a nearby country like Canada? Any suggestions on which country would be the most lenient with extending VISAs?

Question-2: For moving to an H4/EAD status on my wife's H1 (and approved i140)
The lawyer said that I'll need to quit my job, become active on H4, then wait for 90 days to get the EAD card and look for another job (or get the same job with the same company).
Is there any way that I can start the H4/EAD process while Iā€™m still employed? If no, then are there any contractual jobs that I can do during those 90 days (within the software engineering field)?

I look forward to your replies!
