  • Applying for L1A while on L2 stamping

    Hello all,

I have a L1B visa and would like to apply for L2 for my husband. However we are also anticipating that my husband's employer could initiate L1A by end of this year.

    1) Would his L1A take a hit if he has a L2 stamping on his passport during his L1A interview?
    2) If there is no harm for his L1A, what happens to the L2 stamping? Would it get cancelled?

We are skeptical if we should apply for L2 now or wait for his L1A processing. The downside is that the L1A initiation could only happen by the end of this year and the whole process might take upto 9 months(we are newly married and prefer to avoid this long wait). If we take the L2 approach, he could join me in a couple of months. If L2 stamping wouldn't affect his L1A processing then we are thinking of processing his L2 so that he could work in the US until his L1A processing starts. We are also keen on L1A because of the GC benefits it brings along. Are there any problems with this approach?

    1. Most probably not.
    2. One can have both L1 and L2 valid in passport.

I dont see any problems with the approach. While on L2 he can work only after getting EAD which can take 60-90 Days, do keep that in mind.

This is my opinion not legal advice.
