  • H1B after 6 years on L1A

    Hi,

I entered US on May 1, 1010 on L1B visa. My company later got it converted to L1A. They had filed for Green Card in EB2 category for me in 2013 and I have approved 1-140.
My company also filed for my H1B in 2014 and 2015 but I was not picked in lottery both times.
I have earlier spent a month out of US on vacation in 2012 and going for a month vacation this year again.
After recapture of these 2 months vacation time spent outside US, I believe I will be able to remain in US on L1A till June 30, 2017 but 6 years on L/H visa in US will complete on June 30, 2016.

    My question is :
    >>Can I apply for H1B again next year even when my 6 years will complete before Oct 1, 2016.
    >>If not, can I spend 4 months outside US (working from India remotely) so that L/H visa time extends to October 30, 2016. And because I have approved i-140 can my lawyer apply for 3 years H1B?

Can anyone suggest any other way out to extend work authorization after L1A time is up?
My company lawyer thinks GC in EB1 may get rejected because I entered US on L1B.
