l1b to l1a conversion

I am currently on l1b and my i94 expires Dec 21 2015 and my max out date is June 30 2016.
I am applying for l1a as I am currently in managerial capacity. My main concern is my wife is going through pregnancy and due date is 16th nov. if my case gets rejected and if my wife and baby can't travel in Dec what are my options?

Why wasnt L1b to L1A filed as soon as your promotion was given and role and responsibility changed? To avoid such a situation in the future you can apply for the L1B to L1A as early as 6 Months before I-94 expiry and that too in premium.

I got into managerial capacity recently and I am already preparing documentation. My i94 expires Dec 21st 2015 and max out is June 30 2016. So I am applying before 6 months of i94 expire date. I have reports globally uk, india and us. I would be filing l1A in few days. My main question is if it dint go through I have to leave in dec End. If doctor says that my wife or infant baby can't travel in Dec end as due date is nov, what are my options? Can we extend i94 for couple of months on health grounds?
