  • Confusing Info Received from USCIS Customer Service regarding Biometrics

    - April 12th : Submitted I-765 for my first ever EAD along with bank draft for $380 as specified in i-765 instructions
    - April 17th : Received confirmation i-797c and everything updated online to reflect this
    - May 26th : I called as I was curious about the lack of notice for Biometrics as most other folks receive their notice in week 3-5, and I'm actually leaving the US to go back to London for surgery so I won't be in the US for day 45-80 of application

    Conversation:

    Me: Can you confirm if I will be called for Biometrics as I need to leave the US for the next 6 weeks for important surgery in Europe
    Rep: Sir what fee did you submit with your i-765?
    Me: $380 as per the instructions on the form
    Rep: That's the amount payable for deferred application, so no you won't be called for Biometics
    Me: Sorry, to clarify, since I paid $380 I won't be called for Biometrics. Should I have paid more? Will my case be pending as I haven't paid for Biometrics
    Rep: No sir, you should not expect to be called for Biometrics
    Me: So just to be 100% sure, should I have paid an additional $85 dollars for Biometrics testing then?
    Rep: No that's included in the $380 ...


    Can anyone make sense of that? I paid $380 which is the fee for any first time EAD applicant on L2-A visa, correct? That includes any possible charge for biometrics testing if needed?

    So it looks like I won't be called for Biometrics? Or have I missed a portion of the payment?

    Any help appreciated as I don't think the rep fully understood my case here.
    Mid-April 2015

    Day 0: Arrived with husband in the US on L2: Spouse of L1 Visa Holder
    Day 1: Sent i-765 and all supporting documentation via express post
    Day 2: Tracked via express post that package was signed for at USCIS at 10:20am
    Day 2: Realized I had a damn typo on my home address postcode
    Day 5: e-Notification of i-765 received

    Hey - Refer to my case as : Delay in the EAD on L2.

    I received an email from USCIS confrming that no Bio metric is necessary in my case and that I also confirmed over call with the USCIS customer service. Seems like its not a mandate stp any more. $380 is the standard fee irrespective of the Bio metric.
