My employer X filed a L1b visa for me in 2010 and i entered the states in 2010. Have been in this country till now on L1b after an extention, maxing out my current visa this september.
Employer X filed a H1B for FY2016 which was approved last month and will extend my period of stay till Jan 2017 considering the time i spent outside USA in the past 5 years.
However, we were informed that the project is being terminated and i fear of losing my job. While they say the H1 kicks into effect only from Oct 2015, Is there any way i could file for a transfer to Employer Y?
Are there any exception on the H1B start date in the case of a COS from L1 to H1?
Another consultant's immigration attorney mentioned that if i travel outside USA and return somehow my H1B comes into effect. Is that true? What are the risks im facing in this case?
