    can one apply for a L2 dependent visa immediately after rejection of his L1 visa? based on spouse's L1 approved visa?

    Spouse is already in US with a L1 stamping and my L1 is rejected few days back. So can I apply L2 immediately or should I give a gap.

    is carrying a resignation letter mandatory for a L2 visa? since I am currently working or is a Loss of Absense (LOA) letter sufficient?

    Please advise.

    You can immediately apply for L2, no waiting period.

    Carrying resignation is not mandatory.

    For L2 read around https://www.immihelp.com/l2-visa/.

    rarely L2 are rejected, if L1 and L2 both are rejected you would need to either work on the reason for rejection or apply in other category.

      Yes you can apply.

      Requirements for derivatives L-2 visa application are:

      Documents substantiating L-1 principal's status
      Documents substantiating relationship between L-2 applicant and L-1 principal.

      They don't care about your work situation, or why your L-1 was rejected, unless it was rejected due to fraud.
