  • L1 visa layoff

    Hello,
    Any advice or suggestions on this situation will be highly appreciated.

    My brother is here in the US on an L1 visa and his wife is working on an L2 visa. Yesterday he was informed that layoffs will be happening soon and he may be impacted.

    1. If he is laid off, will the company have to pay for his travel and relocation expenses back to India?
    2. Can his wife's company convert the L2 to L1? (She has worked at her company for five years in India.)
    3. If L2 to L1 visa conversion is possible can my sister-in-law stay in the US as soon as application is filed or would she have to go back to India and wait for L1?

    1. Yes. Travel certainly, relocation probably not.
    2. Possibly. Her company's attorney will decide. I think the requirement is worked at foreign office for 1 year in the last 3 years.
    3. If it is filed before husband's last day at work (receipt date<last day) she can stay in the US. But whether she can continue to work or not is not clear. I would say she has to stop working until COS gets approved.
