  • Can my employer file for my L1 before completing 1 year

    Hi.
I am currently on L2 and working for a US based company. My Husband's assignment is over suddenly and his company is planning to send him back to India. I joined its been 5 months. I have few questions

1.. Can my current employer file for my L1 in US?
    2. If yes, do I need to complete 1 year to be in the same company?
    3. Is there any premium process where this can be done before completing 1 year?

    1. Prior to working for this employer in US were you with this employer while outside US for at least 1 Year? If yes then they can.
    2. Yes the rule is 1 year at least while outside US.
    3. One of the requirements is to furnish documents proving you worked with the non US entity outside US for at least 1 year. How will you be able to provide that evidence?

This is my opinion not legal advice.
