  • L1B visa extension - question

    Hi, I'm currently in US on a L1-B Visa (not blanket) and valid till end-March, 2016. The I-94 is also valid till same date.

    For some urgent work, I've to travel to India in December weeks 1-3.

    My queries:
    a: Considering that when I'm returning, my visa is still valid for 3 months, I assume I should not have a problem with immigration. Is that right?
    b: My extension would be filled immediately after my return (since I'm required to be in US after the extension is filled) somewhere in end of December/January first week. How much time it'll take to get a first response from USCIS on approval/denial/RFE?
    c: As I read on this website, as long as the application is pending, I'm allowed to stay in US for 240 days or till a decision is made. Is this date counted from date of filling application; or till the first status response (acceptance/RFE)?
    d: Do I need to go back, if my visa/I-94 is expired, and I've a RFE response pending?

    Any replies would be very helpful and appreciated!!

    Please let me know if you get some details about above questions. I will be going through same phase and need some clarity.
    My Visa & I-94 will be expiring in April but I have to visit India in February for 3 weeks.

      My rfe came after 3 months. Applied in March 2015

      If the 240days after i94 expiry has passed, then yes..
