Hello,
My L1b individual visa denied after I got RFE because documentation was not able to prove that US position require special knowledge.Also as I have only 1.5 years experience in current company,I was not able to prove that i worked in special knowledge capacity for 1 year.
Now my company want to appeal against this decision as there are still 6 months for H1b application and in 2016 company will apply for H1b.
Now I have some concerns
1. Will appealing against this decision has any chance to get visa approval?
2. If again appeal get rejected,then will it impact my history for future as already visa is denied?
3. If H1b is applied, will this rejection cause any issue?
4. Can both L1b appeal and H1b visa be applied simultaneously?
5. Which is a better option
a) to wait for 6 months and complete 2 years in company and again apply for L1b? OR
b) to apply for H1b and check if it selects in lottery. If not selected then again apply for L1b.
