My husband has L1 A visa
Visa vaild: june 2017
I - 94 : april 2016
His company has asked him to file for Green Card thru "EB 1 category"
i am the dependent on L2 visa
Visa expire : 5 march 2015 applied for extension 2 march 2015
1 - 94 expire: 5 march
its september the decision regarding L2 extension is still pending (7 months)
The attorny at my husband company is saying that we can file for GC BUT wait until wife get extension.
We are worried as my husband I - 94 is going to expire next year april 2016
Q) Can my husband can apply for GC even if my L2 extension is pending
