Dear all,
I am from India, IT engineer ( BE ) I am working with this MNC since 5+ years.
I am on H1B visa. I have worked in USA between 2012- 13 ( 10 months) I was back in India filed for Visa extension & returned back to USA in 2015. My current visa is valid till year end, I have filled for extension here is USA. My spouse is with me on H4 visa.
My spouse wants to work here, hence I am planning for COS from H1B to L1B, so my spouse gets L2 visa further EAD.
My Query is :
1. If I file for COS from H1B to L1B I understand that total period H1+L1 is 6 years. I have already stayed in USA for around 10+8 = 18 months. So my initial period of L1 will be 3 years – 18 months or 3 years ? or the period for next extension will be 2 years – 18 months ?
2. Post COS, can we leave country or stamping is compulsory for return ? can I do stamping in Canada for fresh L1B or does it happen in USA ?
3. Incase if my employer file GC under EB2 or EB3 I believe 6 months for PERM & 8 months for 140 approval, post 140 approval can we stay in USA even if my L1+H1 period as well I94 is exhausted ? Post 140 approval can I change status from L1 to H1 and any possibility for job change on H1( cap exempted till 2018)? Will this affect my GC process ?
4. Post 140 approval incase if I COS from L1 to H1, my spouse status will change back to H4 from L2, do we again have to file for EAD ?
5. At which phase of GC in future I may change job ? also travel in \ out of country ?
Need you help and advice, it will be great help for us to make decision
