Hello Team,
I currently have L1B visa which will expire by Nov 13, 2015. My I-129S form has dates expires as "see visa" so I assume I-129S form will expire on same day. Legal unit in my company told me that I have to leave US and apply new blanket visa in US consulate in other countries.
My question is: does my son have to leave US as well?
If not, my plan is:
1. I fly back to China and apply visa in Beijing US embassy on Oct 6. I will apply visa for me and my son together.
2. After I come back to US, my wife will fly back to apply visa for herself.
Since my son is 6 years old and already joins 1st grade in elementary school. If my son does not need to leave US, he could continuously join elementary school courses. If my son has to leave US, he might be absent from school for around 3 weeks.
I do appreciate the prompt answer since I need to decide whether I can make appointment and book air tickets today. Thanks in advance.
