Any mandatory policy to serve in a company for atleast a year for L1A visa?

  • Any mandatory policy to serve in a company for atleast a year for L1A visa?

    I have started my career with IT service co. AAA and served the company for ~5 years. After a stint in product co. BBB, I came back to AAA and serving the company for the past 7+ months now working as a Manager with five reportees. At this point in time, I want to start my L1A visa processing and help with my questions as below

    1. Can I start the process right now? If yes, please let me know about the steps
    2. If no, Is there any mandatory minimum time to be served in AAA to start the L1A visa processing. I heard its one year (not sure) but exception can be made to this rule if the business requires. Pls let me know on this. (2A) Also as a person who served the company already for ~5 years, can there any exemptions for the re-joinees as part of L1A ?

    3. I had a L1B visa during my stint in AAA during 2008-2011. Will there be any effect due to this

    What are the dates when you worked with AAA and BBB.

      Worked in AAA from June 2006 to March 2011 and BBB from April 2011 till Feb 2015

      Joined back AAA in March 2015 and continuing...

        Rule says that you should have worked for at least 1 Year continuously in last three years which you do not seem to have. You will have to wait till March 2016. I dont think there are any exceptions for past employees/past L1 holders.
