  • L-1B visa to expire next year. Need clarity on next steps

    My First L-1B
Visa Issue Date – 19-Aug-2010, Visa Expiry Date – 24-Jun-2013, Total months stayed in US – 21
    My second L-1B (another petition)
    Visa Issue Date – 08-May-2013, Visa Expiry Date – 06-May-2016, I94 Expiry date – 28-Apr-2017, Total months stayed so far – 28

    Questions:

    1. The total time period I can stay in US in L-1B is 6 years since I have 2 different petitions. Is my assumption right? Is that the reason why my I-94 is given until April 2017?
    2. Can I stay in US until my I-94 date. I would have completed a total of 5.6 years (appx) by then
    3. My company will also be initiating GC for me in the next month or so. That being said, what are the options I have in order to stay in US until my GC is process is complete. I know it will take a long time considering Eb2 or Eb3.
    a. My company tried transferring me to H1 this year but unfortunately didn’t get selected in Quota
    b. There is also a plan to try H1 for me next year as well. Even if it is getting approved how long would I get my H1 visa for?
    4. Is there a way to expedite the GC process so that that the PERM is approved before my I-94 date.
    5. Looking at my visa dates, I am confused about my options to stay here beyond 2016. I am not sure which process I should be asking my employer to expedite. Your answers to all my queries would be of great help to me
