    Hello

    This is for my brother.

    He is working with one MNC in India for 1.3 years now. His total work experience is 8 years.

    Now, his current company is offering L1B with US salary and accomodation. Also as they are giving bit below market rate (He is offered 60k in NJ), they promise to process GC after 1 year.

    What kind of cautions should he take?

    Please advise, so he can move ahead in right direction.

    Can you be more specific? What kind of caution are you talking about?

      Something does not seem right to me in the offer.
      My opinion :

      60K will really stretch him in NJ where the tax is on the higher side and Cost of Living is also quite high . If he is going to stay without his family, he may still manage to live decently but if with family- he will be a bit stretched. (Again a lot of this depends on what kind of lifestyle does he expect- totally subjective . Also depends on what is he earning in India , lifestyle in India etc. This is something , you will decide on your own. No one can help you.)

      As for Green Application after one year: This hardly sounds like a deal . It is as if , Company really wants someone at a really low wage to earn for the company but is not interested in employee's welfare.

      L1-B with 8 years experience will most likely qualify for EB2/Eb3 category. EB2 will mean , going through the Labor process and Perm etc and the current priority date is 2005 . What this means is: someone who applied in 2005 will get his green card this year. So , if your company applies for Green Card after one year , it will be 10 years (atleast- unless immigration rules change) before you get the Green Card. Also , on L1B , you can only stay for 5 years at a stretch . So - You will have to go out of US for atleast one year or change your VISA status to H1B to continue staying in US.
      It's quite complicated to mention all the permutation and combination here. A lot things can happen, like - you may try to change your VISA to H1 and then you can carry on staying

      Also, Company can file your Green Card immediately after your arrival. Ask them why such delay. And what is the guarantee that they will file.

      So, doesnt sound like a great deal. The same offer on H1 sounds much better as with H1 , you can change the job which you cant do with L1 Visa. Hope you are able to get a feel of the situation .
      To summarize:
      Salary is very average considering the State you are going.
      With L1B- You can't change job and EB2/EB1 Green Card takes years to come for Indians
      But you will get US exposure to write in your Resume
