  • Disappointed after L1B visa(premium) denied after RFE response. How common is this?

My employer applied for L1B visa for me under individual premium processing. I received RFE notice - replied to it. But USCIS still denied and rejected the visa application.
Disappointed. My boss said he has never seen anything like this?

    How common is this?
    What can I do next?

What was RFE about ? L1 individual rejection is fairly common since last 5-6 Years as scrutiny around L1 has increased.

Your next best option would be to try H1.

This is my opinion not legal advice.

      L1B Visa

There could be many reasons for rejection of your visa. Since applications filed are increasing in number every year, USCIS is strict in approving the applications considering all the factors. You have second option to apply for H1B. Don't be disappointed.

RFE was about asking for more evidence.
I am not sure if L1 individual rejection is common - all my friends who joined with me (same company, similar educational qualification but different teams) got through L1 (one got straight away, one after RFE). I cannot understand if for me it was something missing on my part or luck. If it was luck I have no control it and that is so disappointing.
Skilled worker definition is so vague. It is so disappointing.

L1B rejection is getting common now a days. It's not fully about your luck, but also depends on how well your petition is prepared. You need to convince the officers that your knowledge is really unique and cannot be done by anyone else.

Also, you can reapply for the visa - don't loose hope, it's not the end.
