My husband's L1 A visa is approved and i need the following information to proceed with my L2 EAD.
He was initially on L1B and i had a valid L2 EAD which got expired on Nov 4th 2015 along with my L2 visa. Since his L1A visa had not yet arrived i could not extend my EAD. Now that we have received the documents i want to proceed with L2 visa and EAD renewal.
1) Will there be a change in my visa status since i continue to be on L2 as his dependent. His company said that it is not required to apply for my L2 visa since my I 94 is valid till Feb 2017. Is it mandatory that i first apply for my L2 extension and then EAD? If yes, what is the process. I read about form I 539 but i am not sure if i have to apply for that along with my EAD. Please advise.
2) The parallel thread is we want to travel to India for visa stamping, so can i apply for EAD and then travel or is my presence required here., if we get any RFE my husband will be back in 3 weeks and it can be taken care.
3)I had given Biometrics finger print last time since i had applied online. Will i be required to give it again, this time i plan to send the documents by post and i understand that usually Bio metrics is not required if sent by post.
4) If i wait for travel, get L2 extended and then come back i will lose significant amount of time since it will take 3 months from then for the EAD to arrive. I was working prior to EAD getting expired and they have given me time to get my renewed EAD to join back.
Any suggestions in this regard will be highly appreciated.
