I have a query regarding my max out,
I am maxing out on my L1 visa(5 years) on June 2016. So I am planning to leave USA around last week of May.
Assume I am applying for H1 on April 2016(valid from Oct 2016) and it goes through. If I stay in India for a year and enter USA in June 2017, will my H1 be valid for 6 years or only 1 year?
The question is whether the max out is based on petition date or USA entry and exit data.
