E1 Visa after L1 renewal rejection?

Hello, I wonder if anyone could help me. As I understand it, if a renewal application for an L1A visa is refused, the applicant must leave the country for a minimum of 1 year before they are able to reapply for an L1A visa. My questions is, in that situation could the applicant immediately apply for an E1 visa without leaving the country for one year?
