I94 date extension of L2 dependent

L1-B (of Primary) and L2 (of dependnent) visa expired on July 2015

I-94 date on Primary is of July 2016

I-94 date on Dependent Passport is of Jan 2016 (as dependent Passport is expiring in Jan 2016). Dependent got renewed Passport but US-CBP says they can't correct/extend I-94 date as Dependent renewed Passport is not their database yet.

Please advise what should I do so that dependent need not exit next month (Jan 2016)

receipt of filing of form I539 and stay

Have filed the Form I539 a week ago and same has been received by USCIS, fees has been deducted too but receipt is yet to be arrived.

Is it lawful to stay in US for whom Form I 539 (L2 extension is applied) ? Please suggest.
