  • L1B layoff

    Hello.

I'm in the US on an L1-B visa and have been told I'm about to be laid off. I will most likely be able to go back to work for my former employer abroad.

If the US-based company re-hires me in about a year, will I be able to come back to the US on the same L1 visa I have now? Will I be able to apply for a green card immediately or will I need to work in the US for another year before I can apply for a GC? Will the whole process have to be done all over again?

    Thank you.

You can come on the same visa as long as it's valid. Waiting period to file green card is depends on your employer. There is no such rule that you have to work in USA for 1yr in order to start gc process.
This is not a legal advice. Use at your own risk.
