L2 to L1 - Cooling Off Period

Hi Team :

I am currently on L2 EAD and am traveling back to India as another employer is ready to give me an opportunity to apply for L1A which is an Independent VISA.
my Questions : Is there any Cooling off period applicable in my scenario to apply for L1 and also to Travel back to the US.

Please guide and help.

Were you with this employer in Indian in the past ? You have to be working for the new employer for at least 1 year in last 3 years in order to be eligible for L1 through them.

Hi..Yes..The India Employer and the US Employer are just one.Its just the two entities. So, I have checked with them as well and that I am eligible for filing the petition for L1.
I have worked for India entity for 10 straight years.

Also, is there any cooling off period for L2 to L1 ..as my total stay in USA for L2 and EAD emlp does not exceed 365 days for 2015.
