I'm now on a L1B Visa business trip to US for 83 days and I've never been to US before. During my trip, I was still paid by my company in China. My hiring company in China is a branch of a US based International company. I'd like to stay 2 more weeks for personal vocation in US after my trip. Our HR said there would be some Tax implications if I stayed more than 3 months(83 days + 2 weeks > 90 days) in US(now company don't need to pay Tax for us in US).
I'd like to know if that's true and which laws or regulations it's based on. I heard that that 90 days limitation is refreshed every year, but not sure if it's documented somewhere.
Hope somebody can help me. I need to know it with big urgency.
