  • L1B Visa valid but Petition intended date expired

    Hello Experts,

I have a few questions on my situation below. I have L1 Blanket visa even though I have only stayed in US for 3 months.
Currently I am in India and now after almost 2 years, I need to travel to US.

    I-94 stamping date - 12/10/2013
    I-94 -Expires as of 12/20/2016
Passport - Expires as of 10/19/2017
L1B Visa - Expires as of 12/8/2016 (on Passport)
I-129S -Expires as of 3 years from the date of stamping i.e. 12/9/2016
I-129S Date of intended employment - Expired on 12/08/2015
I-797 Blanket Petition(Issued to my Employer) - Valid indefinitely
But surprisingly as per the VISA stamping on passport PED is 08DEC2016

    Spouse
    I-94 -Expires as of 12/08/2016
    L2 Visa - Expired as of 12/1/2016

    Questions:

    1. Are there any recent changes in the rules for PORT of entry?
    2. Can I travel and work in the US even from same company for different Employment and Job title?
    3. If yes, then my spouse can also travel along?

    HR suggestion:
I129s are scrutinized at Port of entry recently and those with expired work duration are questioned. We had deputed few employees with expired I129s till December 2015 with extended offer letter and client invite for longer duration. We had checked with US Consulate, Chennai at that time and they told that one can travel as long as he/she has valid visas. However, when we checked with US consulate recently, they said that it is not advisable to travel with expired I129s.

Please suggest if I can travel? If not then, is there any issue in applying fresh L1?

    Thanks and appreciate your help!
