L1 visa petition and I-94 expired in 15 days

Hello Friends,

My Company planning to apply my L1 Visa, but my B1 I-94 expired in next 15 days, I am here with my wife and baby and our tickets to fly back to India in next 10 days.

So Can any one suggest me if our lawyer file a petition in next 2-3 days should I legality stay in the US? Or after filing L1 I need to update I-94?

You should leave from USA before your I94 expires.

I would never suggest to file an COS from B1 to L1.

L1 individual petition are most likely to be approved if proper documents are provided & that's the right way also.
