  • What happens post L1 Expiry

    Hello,

I have a very basic question.
I am currently in Canada and have a valid L1B till end of 2019.
If I move to US (using this L1; with same organization) and apply for a Green Card at the earliest possible date, will i be able to reach an "Implied" status by 2019 so that i can continue working till a decision is made on GC?

Thanks a lot for taking time out to read / respond.

If you see the Visa bulletin which comes out every month at https://travel.state.gov/contenthttp.../bulletin.html, you are looking at at least 8 Years of wait for EB2/India to become current. As you know L1B is valid for a max 5 Years (3 years plus another 2 Years extension) so if hypothetically your employer files GC on your first day of arrival into US, and you are able to secure extension for additional 2 Years beyond 2019, that allows you stay and work till 2021, you still need to plan for work till at least 2024. You can try moving to L1A but that will only take you till 2023. Most of the folks move onto H1 visa, as H1 visa can be extended with a pending GC application. An L1 cannot be extended base don pending GC.

This is my opinion not legal advice.
