  • Recently converted to L1A from L1B. Is going to India for stamping is Risk ?

    Hi All,

Recently I moved to managerial position, so my Visa type was converted from L1B Individual to L1A Individual (converted in Dev 2015). My I-797 form is approved till Dec 2017. Now I am planning to vist Mumbai,India in May for Stamping but I heard that its a risk to go for stamping for L1A.
Could you guide me if I can go ahead with Stamping or what I heard is correct. I am not sure why US embassy will reject my Visa if USCIS has already approved by L1A case? Has anyone seen any recent case who's visa was rejected even if I-797 form was approved OR Vice versa ?

    Thanks,
    Swanand

How long have you already stayed in USA on your L1B?

Once an individual L1A petition is approved by USCIS, there is very less chances of visa rejection - unless you really goof-up in the interview or respond wrongly with what is written in your petition.

Thanks for reply. The Only concern I have is. Since my L1A was converted recently I have hardly 4 month of Manaegerial experience. It should not happen that at stamping they will say, you do not have much experience as L1A.
      Do you see that possibility?

Possibility of rejection is always there when you attend any visa stamping interview. But if you are convinced of your ability to justify the L1A I dont see any issue.

This is my opinion not legal advice.
