  • Working on I94?

    Hi,

My L1B Visa will expire (5 years) in September 2016 however the expiry date of my I94 is March 2017. My question is whether I can stay and work beyond September 2016?

    Thanks.

If you are exhausting your 5 Year stay in US in L1B Status in Sept 2016, i would not suggest you stay beyond that time even if you have a valid I-94. I-94 are generally issued by CBP and they may not be aware of all the regulation, if you stay beyond the 5 Year limit you will be violating the terms of the visa.

This is my opinion not legal advice.

With a valid I94 your stay in US will be counted Legal. However without a valid petition/visa you will be out of status & cannot work.

Come back as soon as your petition expires.
