  • L1B individual to L1a blanket cos stamping in Mexico or Canada

    Hello,

    I have a valid L1B individual and I94 till Jun 2017. Company recommends converting to L1A as I recently got promoted. Attorney suggest conversion from L1B individual to L1A Blanket and get stamping outside the US. If I choose to go that route, can I go to Mexico or Canada to get L1A blanket stamped? In case, they don't approve my blanket petition, can I reenter using my original L1B/I94 that has validity till Jun 2017? I will be traveling with my daughter who is 7 and I want to avoid being stranded with my child outside the US being middle of school year etc. Traveling to India is very expensive and long hence considering Mexico or Canada as child is involved. Attorney is suggesting that if I don't want to travel out, they can file L1A individual cos. However if that doesn't get approved, they can't apply in Blanket after. So they suggest to try blanket first and if not, then consider individual.

    Question: What are the odds of Mexico or Canada canceling existing L1B if they don't approve L1A blanket cos?
    If I don't go for blanket L1a cos and choose individual L1a and if it doesn't get approved, can I reapply shortly and try again?

    Could someone please suggest best route?

    Once you move out of US, your I94 expires. You'll need a new I94 when you come back next time(on any visa).

    Yes, you can go anywhere outside US to get your visa approved/stamped, but it is always recommended to go to home country.

    In case if they reject your visa in Mexico/Canada (and hopefully not your current valid visa), you can come back considering your that visa/petition is still valid.

    In some cases, people have reported that while rejecting one visa, most of the time they cancel earlier visas.

      Thank you for your response, appreciate it. I think going for blanket from here is scary, given that kids are going to school.
