    Hello All,

    This is a long story but will try to make in short

    My spouse is in L1 - B Visa. I am in L2 Visa with EAD (already approved). The company where I was employed in my home country is a US based company. They decided to move me to US in 2015 since I wanted to quit and move to US. The company tried my L1- B visa but it got denied ( will not go into details of why )

    So I am currently working for the same company but in L2 - Visa with EAD

    My company is obviously concerned about that and want me to move to a different Visa status so that my work permit & visa is not dependent on my spouse employment. Hence we started preparations for my H1 Visa processing . NOTE - I work remotely from different city. Basically the same location from where my spouse works. My company does not have any office in my city. I work from home


    I got to know today that IRS or some other department ( not sure which dept of US govt) rejected the labor certification because I work from different city and my company does not have any office in this city. So basically I cannot apply for H1 Visa as well.

    What are my options to move out of L2 Visa and still be able to work in US

    NOTE -

    The company where my spouse works has initiated processing for Green Card. They are aiming for eb1 status. Current status is- They will file application with USCIS for EB1 status by next month...This is just as FYI...

    Another Point - My Spouse L1 B visa is reaching 3 year mark this December. It can get extended to another 2 years and the same applies to my L2 Visa & EAD. Hence the company where my spouse works has also initiated processing for H1 Visa


    Any help or suggestion is appreciated !!

    L1B is not eligible for EB1, L1B goes through EB2 & will take years to get you your GC.

    There are pros and cons of EB1 vs EB2 visas. Find out which is suited for you by comparing requirements, processing time, and cost.
