Once B2 to L1 I129 Petition got approved by USCIS do I need to travel to India

  • Once B2 to L1 I129 Petition got approved by USCIS do I need to travel to India

    Can someone please confirm, within US if I got my B2 to L1 Petition approved by USCIS (for 2 years), do I mandatory required to travel to India to get my Visa Stamping done on Passport, or whenever later in a year I travel to India, before entering US I can stamping done at Consulate.

    Also based on I129 Petition Approval Notice, can my family, who are in India, get L2 Visa Stamping done at Consulate & travel to US.

    You doing COS from B2 to L1? There are high chances that petition will be denied.

      Thanks for your reply. Probably I mentioned it wrong. Actually I got L1 approval notice from USCIS, I am in US, approval notice has new I-94 no as well.
      My doubt is since there is no Visa Stamping on my Passport, do I mandatory go out to India & get Visa Stamping done, or I can stay for about a year & once I go back to India at that time I can approach Consulate to stamp Visa.

      Since my family is in India & want to get Visa formalities done for them, can I file their DS-160 with Approval Notice Receipt No.?

        If you got the L1 Approval notice with I-94 then it means your COS from B2 to L1 was approved and you must be working and getting paid by L1 employer.

        You do not need to immediately go out to get the stamping done, you are fine to work on the approval notice till I-94 validity. But yes, as and when you leave US, in order to return back on l1 status, you would first need to get yourself a L1 visa by going to a US Consulate.

        As for your family, yes, you can fill the DS-160 based upon the Approval notice and they can attend the visa stamping interview.
