Can L2 Dependent Travel to US with L1-B extension Approval Copy?

  • Can L2 Dependent Travel to US with L1-B extension Approval Copy?

    Hi,

    I am currently working in US on L1 - B Visa (Blanket Petition) and the PED (Petition Expiration date) on the visa is of May 10th, 2016.

    My L1-B Visa is valid till - Feb 2019
    Blanket Petition validity - I-797 - Valid Indefinitely
    I-129S - is only valid till - May 10th, 2016
    Most Recent I-94 says - Admin untill Feb, 21st 2019.
    PED on Visa - expires on May, 10th 2016

    My company is applying for the extension, however they cannot apply for my Wife (L2) as she is currently not in US and wont be here till that time also.

    My wife is on L2 visa with same above details on her Visa as well, how will the extension work for her, do we need file separately for her??

    Can i share with her a copy of my extension approval to present at immigration when she enters the U.S.? Will that work for her OR is there something else required as well.

    I request you to share input as this is something really important to know and have very less idea about.

      Is there any annotation on your spouse's visa ? if not, she won't need any of these documents to enter into the USA.

        Thanks for your reply sir to answer your question -

        yes, The only annotation difference on her visa is that - "Blanket L2, PA: My Name"

        wherein on my Visa it says annotation - "Blanket L-1; Must Present I-129S at POE"

        She is currently in India and her Visa details are also the same as mine below. My company will apply for extension before May 10th and I can continue working while the extension process is in progress and she will only travel after May10th

        I am not sure does she need confirmation of my extension before she can travel here OR my pending extension process documentation will work?? Also, will she be required to apply for any extension in India also??

          That's fine, she can travel with her own valid visa. Mostly no other documents will be required.

          But to be on the safer side, let her carry photocopies of your passport, visa, I797 & I129S. In case if you could fine extension before she starts from India, provide her extension application copies.

            Sure, thanks for the inputs. this really helps.

            I will apply extension before she leaves India, wanted to know will she need the approved extension document OR even the application extension copy which will mean that I have applied for extension will work for her??

            And I don't think if she will be required to file a separate extension in India, right??

              Extension application (in progress) copy would work. Please ensure she has a valid visa before she travels.

                Yes, She has a valid Visa for next three years till 2019.

                So should be good there.

                  Hi,

                  I am also having the same issue. My petition expired on march 1st 2016 and my depedents are with me now in US and they have a plan to travel internationally. my I129s extension is in process when i checked the same thing to my attroney they told that my dependents need to have copy of approval notice along with valid L2 visa to reenter to US and they suggested me to process my petition extension in premium.
